1. Agreement to Terms

By accessing or using the ConstructScan AI platform, including our LiDAR scanning hardware lease services and BIM-to-scan comparison software, you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you are expressly prohibited from using the service and must discontinue use immediately.

2. Service Description

ConstructScan AI provides automated verification of construction site progress by comparing physical site data (LiDAR point clouds) against Digital Twin or BIM models (IFC, RVT, NWD formats). Our service is intended as a quality control tool and does not replace the requirement for official architectural or structural sign-offs.

3. User Responsibilities

• Accuracy of Input: Users are solely responsible for the accuracy and currency of the BIM/CAD models uploaded to the platform. ConstructScan AI is not liable for errors resulting from outdated design documentation.
• Hardware Handling: If leasing hardware, users must follow all safety and operational guidelines. Misuse resulting in hardware damage will incur repair or replacement fees.
• Field Verification: Automated alerts must be verified on-site by qualified personnel before any structural changes or rework are performed.

4. Data Ownership & Privacy

Customers retain full ownership of all site data, photographs, and LiDAR scans uploaded to the service. ConstructScan AI retains ownership of the underlying AI algorithms, proprietary comparison models, and any anonymized metadata generated to improve system performance.

5. Limitation of Liability

ConstructScan AI shall not be held liable for any indirect, incidental, or consequential damages resulting from project delays, material waste, or structural errors. Our total liability is limited to the fees paid for the service in the six (6) months preceding the claim.

6. Termination

We reserve the right to terminate or suspend your access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the business interests of ConstructScan AI.
